1. Purpose and scope of application

These conditions govern the access, navigation and use of the website www.wecharter.es (hereinafter, the "Website"). Accessing the website assigns you the status of user, which implies full acceptance of these terms.

2. Booking process and pre-contractual arrangements

The User understands and accepts that:

  • Booking Request: The submission of a booking form through the website does not constitute an immediate binding contract, but rather a request for availability.

  • Confirmation: The booking will only be effective once Wecharter has confirmed availability in writing and the User has made the corresponding deposit or down payment.

  • Documentation: The User undertakes to provide accurate information, including their identity and, in the case of bareboat charter, the required valid nautical qualifications.

3. Relationship with the rental agreement

IMPORTANT: These Terms and Conditions govern only the use of the Website. The contractual relationship arising from the rental of the vessel (deposits, fuel, check-in/out, on-board responsibilities and weather-related cancellations) shall be governed exclusively by the specific Vessel Rental Agreement that the parties will sign privately prior to the commencement of the service.

4. Intellectual and industrial property

All content on the Website, including but not limited to: texts, photographs of the vessels, logos, trademarks, icons and graphic design, are the property of Wecharter or of third parties who have authorised their use.

  • Any reproduction, distribution or transformation of any content on this website without the express written authorisation of WeCharter is strictly prohibited.

5. Liability for content

Although WeCharter makes every effort to keep the information up to date, it cannot be guaranteed that boat descriptions, prices or availability will be free of typographical errors at all times.

  • Wecharter reserves the right to modify, without prior notice, the prices and specifications of the vessels displayed for technical or commercial reasons.

6. Use of the website and user conduct

The User undertakes to make lawful use of the Website. The following are prohibited:

  • Using the website for fraudulent or unlawful purposes.

  • Introducing computer viruses or carrying out any action that may damage the website's infrastructure.

  • Extracting content in an automated manner (scraping) for comparative or commercial purposes without permission.

7. Third-party links

The Website may contain links to external sites (weather forecasts, marina websites, etc.). Wecharter assumes no responsibility for the information contained on such third-party sites or for their functioning.

8. Amendment of the conditions

Wecharter reserves the right to amend these terms at any time in order to adapt them to legislative developments or changes in the services offered.

9. Applicable law and jurisdiction

For any dispute arising in connection with the Wecharter Website, Spanish legislation shall apply, with the Courts and Tribunals of the city of Barcelona having jurisdiction.
